You understand people are autoclaiming either way right? I don't think you know what autoclaiming is honestly. The swap services I linked will not lose to an autoclaimer, so technically there isn't that much risk that's added at all, if anything.

Yes in many areas of the US prior convictions are being wiped and incarcerated individuals are being released for cannabis convictions in now legal areas...

Those are low-level convictions. They wouldn't wipe away all marijuana crime. 
Also, if I'm not mistaken they're just wiping it off their records after they've already served
The users that were banned were 100% aware of the terms of service and failed to follow them, they were given a chance to redeem themselves and still failed to do so.
It's not like they're completely off the site. They can choose to pay back what was once against the rules to come on and do what they love doing best
